REFUNDS, RETURNS, AND FINAL SALES

ALL SALES ARE FINAL. Due to the nature of fine wine and collectible wine products, Monday Wine Consulting ("MWC") does not offer refunds, returns, exchanges, credits, or cancellations after an order has been placed and payment has been received.

Customers are encouraged to carefully review all order details prior to completing a purchase. By placing an order, the customer acknowledges and accepts full responsibility for the selection and purchase of the wine.

Opened bottles are not eligible for return, refund, exchange, or credit under any circumstances. Once a bottle has been opened, MWC has no practical means of verifying the condition, storage, handling, or authenticity of any claim relating to that bottle.

MWC reserves the sole discretion to address documented order fulfillment errors, including shipments containing incorrect products, quantities, or items damaged prior to shipment. Any such claims must be reported within twenty-four (24) hours of delivery.

TITLE, RISK OF LOSS, AND SHIPPING LIABILITY

Title to and ownership of all wine purchased from MWC transfer to the purchaser immediately upon receipt of payment. Risk of loss, damage, deterioration, theft, delay, or destruction likewise transfers to the purchaser at that time.

MWC acts solely as a facilitator in arranging shipment on behalf of the purchaser. The purchaser assumes all responsibility for selecting shipping dates, shipping methods, delivery locations, and weather conditions affecting the shipment.

Wine is a temperature-sensitive product. MWC strongly recommends that customers consider weather conditions before requesting shipment. By authorizing shipment, the customer assumes all risks associated with temperature fluctuations, weather exposure, transit delays, and other conditions beyond MWC's control.

MWC shall not be liable for any loss, damage, spoilage, leakage, oxidation, cork failure, label damage, capsule damage, cosmetic damage, theft, delay, misdelivery, failed delivery attempt, carrier negligence, carrier error, weather-related damage, or any other deterioration occurring after title and risk of loss have transferred to the purchaser.

Customers are solely responsible for providing accurate shipping and contact information. MWC shall not be responsible for delays, losses, additional shipping charges, returned shipments, or other damages arising from incorrect or incomplete shipping information provided by the customer.

ADULT SIGNATURE REQUIREMENT

All shipments containing alcohol require the signature of a person of legal drinking age at the delivery address. The purchaser assumes responsibility for ensuring that an eligible adult is available to receive the shipment. MWC shall not be liable for carrier storage fees, return shipping charges, failed delivery attempts, or product deterioration resulting from unsuccessful delivery attempts.

SHIPPING INSURANCE

Shipping insurance is optional and available for purchase at a rate of 2.5% the value of the shipment, on top of shipping expenses. Unless shipping insurance is purchased, all shipments travel entirely at the purchaser's risk.

Shipping insurance covers only loss of shipment or physical breakage occurring while in transit and only to the extent approved by the insurance provider. Shipping insurance does not cover spoilage, heat damage, cold damage, label condition, capsule condition, cork condition, leakage, cosmetic damage, age-related variation, diminished quality, drinkability concerns, or any other condition unrelated to carrier loss or breakage.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, MWC's total liability arising out of or relating to any order, purchase, shipment, product, or service shall not exceed the amount paid by the customer for the specific product giving rise to the claim.

Under no circumstances shall MWC be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to lost profits, lost business opportunities, loss of enjoyment, diminution in value, replacement costs, storage costs, or transportation expenses.

ACCEPTANCE OF TERMS

By placing an order with MWC, the purchaser acknowledges that they have read, understood, and agreed to these terms and conditions, including all provisions relating to final sales, risk of loss, shipping liability, insurance limitations, and warranties.
